1. Agreement to these terms

These Terms and Conditions ("Terms") govern your access to and use of Flowstate, a spatial thinking canvas for AI-assisted inquiry (the "Service"), operated under the trade name Flowstate by [OPERATOR LEGAL NAME] ("we", "us", or "our").

By accessing or using the Service — including signing in, creating a canvas, sending prompts to AI features, uploading content, or collaborating with others — you agree to these Terms. If you do not agree, do not use the Service.

We may update these Terms from time to time. The "Effective date" at the top will change when we do. Continued use after changes take effect constitutes acceptance of the revised Terms.


2. About the Service

Flowstate is a web-based application that lets you:

  • Place questions and AI-generated answers on an infinite spatial canvas
  • Branch parallel lines of inquiry without losing context
  • Create artifacts (tables, maps, charts, code, and other structured outputs)
  • Attach files and import content from linked sources
  • Collaborate with others on shared canvases (where enabled)
  • Optionally connect a Google Workspace account to import or export content

The Service is under active development. Features, limits, and availability may change without notice.


3. Eligibility

You must be at least 13 years old to use the Service. If you are in the European Union, United Kingdom, or another jurisdiction that requires a higher minimum age for consent to online services, you must meet that age (typically 16).

You represent that you have the legal capacity to enter into these Terms and that you are not barred from using the Service under applicable law.

The Service is not intended for children under 13. We do not knowingly collect personal information from children under 13.


4. Accounts and authentication

4.1 Sign-in

The Service uses Google sign-in (via our authentication provider, Supabase) to create and access your account. By signing in, you also agree to Google's applicable terms and privacy policy for that authentication flow.

4.2 Your responsibilities

You are responsible for:

  • Maintaining the security of the Google account you use to sign in
  • All activity that occurs under your account
  • Ensuring information associated with your account is accurate

4.3 One account per person

You may not create multiple accounts to evade restrictions, abuse the Service, or circumvent enforcement actions.


5. Your content

5.1 Ownership

You retain ownership of content you create, upload, or submit through the Service ("User Content"), including questions, answers, artifacts, attachments, notes, and canvas layouts.

5.2 License you grant us

To operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, transmit, and sync your User Content — solely as needed to:

  • Provide the Service to you
  • Enable AI-assisted features (including sending relevant context to AI providers)
  • Enable collaboration features you initiate
  • Back up and restore your data
  • Comply with law and enforce these Terms

This license ends when your User Content is deleted from our systems, except where retention is required by law or permitted under our Privacy Policy (e.g. aggregated or de-identified data, or feedback you submitted separately).

5.3 Your obligations

You represent that you have all rights necessary to submit User Content and to grant the license above. You must not submit content that:

  • Infringes intellectual property or privacy rights of others
  • Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Contains malware or attempts to compromise the Service or other users

6. AI features

6.1 How AI works in Flowstate

When you ask a question or use AI-powered features, we send relevant information to third-party AI providers (primarily Anthropic) to generate responses. This may include:

  • Your prompt and conversation history on the canvas
  • Attached files (text, images, PDFs)
  • Context from ancestor cards and artifacts on the same canvas
  • Content fetched from URLs you include in a message (where that feature is enabled)

6.2 AI limitations

AI outputs may be inaccurate, incomplete, biased, or inappropriate. You are solely responsible for reviewing and verifying AI outputs before relying on them.

The Service does not provide professional advice (legal, medical, financial, or otherwise). Do not use AI outputs as a substitute for qualified professional judgment.

6.3 Third-party AI terms

Your use of AI features is also subject to the terms and policies of the underlying AI providers. We do not control how those providers process data beyond what is described in our Privacy Policy.


7. Collaboration

Where collaboration is enabled, you may invite others to a canvas by email or share link, and assign roles (such as owner, editor, or viewer).

  • You control invitations. Only invite people you trust. Editors and viewers may be able to see User Content on shared canvases.
  • Collaborator conduct. You are responsible for the conduct of people you invite, to the extent permitted by law.
  • Limits. We may impose limits on the number of collaborators per canvas or other collaboration features.

We may display your name and profile photo to collaborators for presence and attribution purposes.


8. Google Workspace integration (optional)

You may optionally connect a Google account to import from or export to Google Drive and Google Sheets. This requires a separate OAuth authorization with scopes you approve at connection time.

  • You can disconnect at any time through the Service.
  • Disconnecting revokes our access tokens and removes stored connection data as described in our Privacy Policy.
  • Your use of Google services remains subject to Google's terms and policies.

9. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Harass, abuse, or harm others
  • Attempt to gain unauthorized access to the Service, other accounts, or our systems
  • Reverse engineer, decompile, or scrape the Service except as permitted by law
  • Interfere with or disrupt the Service (including via automated means, excessive requests, or denial-of-service)
  • Circumvent usage limits, collaboration caps, or access controls
  • Use the Service to develop competing products through systematic extraction of outputs
  • Resell or commercially exploit the Service without our written permission

We may investigate violations and suspend or terminate access at our discretion.


10. Intellectual property

The Service — including its software, design, branding, documentation, and underlying technology — is owned by us or our licensors and is protected by intellectual property laws.

These Terms do not grant you any right to use our trademarks, logos, or brand elements except as necessary to use the Service in accordance with these Terms.


11. Beta and availability

The Service is provided on a beta / early-access basis. It may contain bugs, experience downtime, or change significantly.

We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time.


12. Fees and payment

The Service is currently offered free of charge. We reserve the right to introduce paid plans or features in the future. If we do, we will provide notice and any additional terms before charging you.


13. Termination

13.1 By you

You may stop using the Service at any time. You may delete individual canvases through the Service. To request deletion of your account and associated data, contact [PRIVACY EMAIL] (see our Privacy Policy).

13.2 By us

We may suspend or terminate your access if you violate these Terms, if required by law, or if we discontinue the Service. Where reasonable, we will provide notice.

13.3 Effect of termination

Upon termination, your right to use the Service ends. Provisions that by their nature should survive (including licenses granted for content already shared with collaborators, disclaimers, limitation of liability, and dispute resolution) will survive.


14. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that AI outputs will be accurate or reliable.

Some jurisdictions do not allow exclusion of certain warranties; in those cases, our disclaimers apply to the fullest extent permitted by law.


15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunity, arising from your use of the Service.
  • Our total liability for any claim arising from or relating to the Service or these Terms will not exceed the greater of (a) USD $100 or (b) the amount you paid us in the twelve (12) months before the claim (if any).

These limitations apply whether liability is based on contract, tort, negligence, strict liability, or any other theory, even if we have been advised of the possibility of such damages.

Mandatory rights: Nothing in these Terms limits liability that cannot be limited under applicable law, including consumer protection rights in the EU, UK, India, or your home jurisdiction.


16. Indemnification
